Justice Ahmed Mohammed of the Federal High Court in Abuja, has declined the injunction by Senator Bukola Saraki to stop his arrest as ordered by the Code of Conduct Tribunal.
The Code of Conduct Tribunal today ordered the Inspector General of Police to arrest and produce Senator Saraki in court Tuesday by 10 a.m.
With the situation at hand, the Senate President’s options are getting limited, although his lawyers have hinted of continuing the legal filibustering in the appeal court.
Last week Thursday, Justice Mohammed had given an order summoning the officials of Code of Conduct Bureau and Code of Conduct Tribunal to his court today, an order interpreted by Saraki’s legal team as meaning the stoppage of the planned trial at the tribunal.
The tribunal however said the interpretation was of no effect as it enjoys concurrent powers with the Federal high Court.
The debate seems a mere academic exercise for now as Mohammed refused to grant the prayer wanted by the Saraki team today, that the court set aside the arrest warrant issued by the tribunal last Friday, more so as the officials of the Tribunal disobeyed the court.
Barrister A.O Adelodun argued Saraki’s case, while Taiwo Abidogun stood in for the defendants. The latter told the court that it lacks the power to make the order being requested by Team Saraki.
Justice Mohammed declined to rule on all the issues raised and adjourned matters till 30 September.
