The Lagos State Police Command has said that having sexual intercourse in a car is illegal, as offenders risk three years imprisonment.
Chike Oti, the state Police Public Relations Officer, PPRO, said the act contravened Sections 134 (a) and 136 of the Criminal Law of Lagos State 2015.
Oti was reacting to a tweet credited to Abayomi Shogunle, the head of the Police Complaint Rapid Response Unit, who earlier said that having sex in a car is not criminal.
Shogunle in a tweet, had said, “Sex in a car in a public place is not a crime in Nigeria provided; Location is not a place of worship, parties are 18yrs+, the act is consensual (agreed to by parties), parties are of opposite sex. If threatened with arrest over above, pls contact @POLICENG_PCRRU.”
Oti, according to PUNCH, also said that “Section 231 of the Criminal Code Act, which is a Federal law and applicable in states other than the northern states where Penal Code is applicable, also make Indecent Acts punishable.”
He noted that Edgal Imohimi, the state Commissioner of Police, had received legal advice from the Director of Public Prosecution of the state Ministry of Justice and Legal Department of the state Police Command.
“Going forward, the authorities of the Lagos State Police Command hereby declare that the assertion that sex in a car in a public place is not a crime in Nigeria is misplaced, as the provisions of the Criminal Law of Lagos State prohibit such acts in public, even if it is done with consent of the other party,” Oti said.
“To this end, the Commissioner of Police, CP Edgal Imohimi, wants Lagosians to be guided by relevant sections of the law against such acts.”
