An High Court in Abuja has asked the acting national Chairman of the Peoples Democratic Party (PDP), Uche Secondus to vacate the seat.image

Justice Hussein Baba-Yusuf also ordered that fresh election should be conducted to elect a new and credible chairman from the north east zone within 14 days.

The judge held that the action of Secondus was illegal.

A former Political Adviser to former president Goodluck Jonathan, Ahmed Gulak had in the originating summons filed by his counsel Jibrin Okutepa (SAN) said Secondus, who is a deputy chairman of the party ought not to also assume the position of Acting National Chairman after the exit of the former Chairman Adamu Mu’azu.

He cited section 47(6) of the PDP Constitution while maintaining that where a vacancy occurs in any of the executive committee offices, the party shall appoint another person from the “area or zone where the officer originated from pending the conduct of election to fill the vacancy.”

He, therefore, prayed for an order restraining Secondus from acting in the office of the National Chairman or carrying out any other functions or duties pertaining to the office.

Meanwhile, the judge has also dismissed an application by Ken Emeakayi, PDP chairman in Anambra State and 36 other state chairmen of the party through their counsel Emeka Etiaba (SAN) seeking to join the suit as interested parties.

Counsel to PDP and Secondus, Ochai Otekpa Tuesday said that the party will appeal the judgement.
